On 6 April 2011, the Tier 1 General Scheme was closed to new applicants. However, it is still possible to apply for an extension application under this scheme if you are currently in the UK as a HSMP or a Tier 1 General holder.  This UK visa category entitles an individual to remain in the UK without having an offer of employment and/or to take up self-employment.

Requirements for visa extension under the Tier 1 General

In order to qualify  for an extension under Tier 1 General Scheme you must show that you are eligible for a minimum threshold of 75 or 80 points under the transitional arrangements. You can score points in the following categories:

  • Education - to be awarded points in this category you can rely on the qualification submitted with the initial application or a higher one as long as  the degree and awarding  institution are recognised.
  • Past Earnings - the number of points available is measured by your gross earnings for the past 12 months. You can score up to 75 points in this category depending on your level of earnings.
  • Age - points are awarded on the basis of your age.  Those of you over the age of 40 might not be able to claim points in this category. However, you can still qualify by claiming points in other categories.
  • Previous Work or Study in the UK - if you have worked or studied in the UK you may be able to claim 5 points in this category.

A visa under the Tier 1 General/Highly Skilled category can be extended for a further three years. This category can lead to Indefinite Leave to Remain (ILR) upon completion of five years in the UK.  If your HSMP visa was granted prior to 3 April 2006 you may exceptionally qualify for settlement after completing four years in the UK following the HSMP Forum's Judicial Review of 6 April 2009.
