  • Tier 2 Settlement- MAC recommendations.

    The MAC was commissioned by the government in June 2011 to identify the most significant economic criteria for determining which Tier 2 migrant workers could settle permanently in the UK and what the economic effects of restricting or removing settlement rights would be.
  • Update on settlement requirements for Tier 2 migrants and work permit holders

    On 6 April 2011, the Immigration Rules were amended to introduce a salary requirement for settlement applications made by work permit holders and migrants under Tier 2 of the points-based system. Their applications must now include written confirmation from their employer or sponsor that they are being paid at or above the appropriate rate for their job.
  • Changes to the Tier 2/work permit visa category

    Earlier this week the government accepted the Migration Advisory Committee (MAC)’s recommendations, which were submitted for consideration in September 2011. In its report, the MAC focused in particular on those industries and sectors where it deemed that resident workers are now available to fill the vacancies.

  • Judgement on carers of British Citizens

    The Court of Justice of the European Union (ECJ) recently handed down judgement in the case of Ruiz Zambrano (C-34/09). This judgement creates a right to reside and work for the sole carer of a dependent British citizen when that carer has no other right of residence in the UK and removing the carer from the UK would mean the British citizen would have to leave the European Union.

  • British nationality and referees for the good character requirement

    The Migration Advisory Committee (MAC) has today advised that the Shortage Occupation List be revised to restrict migrants from outside the European Economic Area to a smaller proportion of occupations within the UK labour market.
