Tier 2 General: Requests for a Certificate of Sponsorship suspended!

Following the UK Government’s Statement of Intent published in February 2011 the last allocation of certificates of sponsorship (CoS) under the Tier 2 General interim limit will take place on 4 March 2011. Valid requests for additional COSs received on or before the 1 March 2011 will be considered at the 4 March panel and all sponsors will be notified of the outcome by 11 March 2011.

As of 1 March 2011 it is no longer possible to submit a COS (AR) form for new jobs. Sponsors can continue to use the existing CoS (AR) form only to apply for certificates of sponsorship for extensions of Tier 2 (General) or work permit leave where migrant’s leave expires before or on 6 April 2011.

Any certificates of sponsorship issued under the interim limit that are not assigned to a migrant prior to 6 April 2011 will be cancelled.

Form 6 April Tier 2 applications will be divided between "restricted" and "unrestricted" with only the former requiring a UK employer to be issued with a Certificate of Sponsorship (CoS).

The sponsor’s allocation period, or ‘CoS year’, will now be changed and will run for a fixed period from 6 April to 5 April the following year.  On 6 April 2011 CoS allocation for Tier 2 (General) and/or ICT will be set to zero unless sponsor takes appropriate actions which will depend on whether the CoS they require is restricted or unrestricted.

Sponsor requiring allocation of unrestricted COS will have to complete a form and forward it to the UKBA for consideration before 11 March 2011. There will be no limit on the number of unrestricted certificate sponsor can request during the following 12 months and it will be possible to apply for additional unrestricted COSs throughout the year.

The application process for restricted CoS will open in mid-March. All requests for a restricted CoS for must be made using a new online application form.  Applications for a restricted CoS will be assessed against a points table and will be allocated to sponsors on a monthly basis throughout the year.  The restricted CoS application form and full guidance for sponsors on the application process will be published in the next few weeks.
