New path to citizenship

There is no official guidance available as yet but few general points may be worth noting:

  • Government’s intention is to introduce new path to citizenship no earlier than July 2010
  • There will be transitional protection (up to 2 years) for those who have reached at least the stage of applying for indefinite leave to remain by the time new path to citizenship is introduced
  • Under the new path, current second stage of indefinite leave to remain will be replaced by probationary citizenship (form of limited leave to remain)
  • Length of probationary citizenship will vary between 1 and 3 years for a person applying for citizenship; and between 3 and 5 years for a person applying for permanent residence (current indefinite leave)
  • The main reason behind introduction of additional stage is to extend the period during which a migrant will be excluded from various services and benefits
  • A key factor in determining whether a migrant is allowed to spend the minimum periods on the second stage will be depend upon satisfaction of the activity condition
