Summer 2011 interns exempt from Tier 2 cooling off period!

10 June 2012

The UK government recently introduced a cooling off period for Tier 2 (General) applicants.  From February 2012, applicants who have been issued with a Tier 2 (General) visa need to remain outside of the UK for a period of 12 months from the end of their last application before they can apply again under the same category. Currently, the cooling off period is temporarily lifted for students who worked as interns in the UK during the summer of 2011 to allow them to return to the same company working at graduate jobs. The exemption is valid until 31 October, 2012.

For Tier 2 (General) visa applicants to qualify for temporary exemption, he/she must meet the following criteria:

  • be sponsored by the same company where you worked as an intern in the summer of 2011;
  • have previously been granted permission under Tier 2 (General) with that company for a temporary job lasting no more than 4 months as an intern or a summer associate;
  • have completed a degree course within 18 months of your application;
  • be returning to the UK on a graduate trainee scheme;
  • be making a Tier 2 (General) application with a start date on the certificate of sponsorship of 31 October 2012 or before.

If you meet all of the above requirements for the exemption and wish to submit a Tier 2 (General) application, our consultants at Migra & Co offer different levels of support to increase the success rate of your submission.

If you are not qualified for an exemption but still wish to work and live in the UK, our team of dedicated consultants can offer visa application advice that is tailored to your needs and circumstance.
