New visa route for Turkish entrepreneurs

Following the findings of the European Court of Justice in the case of Tum & Dari (C-16/05) the UK Border Agency has introduced a visa route which will enable Turkish nationals applying from outside of the UK to enter the country in a business category under the European Community Association Agreement (ECAA). This category was previously not available for applicants residing outside of the UK at the time of the application.
Furthermore, it was announced that as from April 2010, Turkish nationals who are already in the United Kingdom will not able to switch into the Turkish ECAA business category. The switching will be restricted to visitors, those already in the UK with permission to run a business or exceptional case which will be consider at the UKBA discretion.
Changes to the UKBA policy concerning the ECAA which were introduced on 1 June 2009 remain in force and will affect all applicants who made an application under the terms of the ECAA on or after 1 June 2009.
