Doctor in Training- further immigration changes

The statement of changes in the Immigration Rules CM7701 with effect from 1st October 2009 has amended the condition which prohibits Tier 1 Migrants from taking employment as a 'Doctor in training'.

Applicants who are now applying to switch into the Tier1 General category will be subject to paragraph 245D(c )iii which states that:

(iii) no Employment as a Doctor in Training, unless the applicant is applying for leave to remain and has, or has last been granted, entry clearance, leave to enter or leave to remain that was not subject to a condition restricting their employment, whether that is employment as a Doctor in Training or otherwise, and has been employed during that leave on an NHS Foundation Programme or as a Doctor in Training.

Therefore, only those migrants currently in the United Kingdom working as a 'Doctor in Training' or on an NHS Foundation programme can apply to be exempted from the restriction. In order to do this they must provide the documents specified in Annex D of the Guidance. Without this evidence an applicant requesting to extend their leave to remain in the United Kingdom will be issued with the restriction that they are unable to work in this field.
