UK visas: Tier 1, 2 and 4 - maintenance requirement

08 February 2010

As mentioned in our previous UK immigration articles and blogs, understanding and complying with the maintenance requirement for the main applicant and his/her family members is key to the successful outcome of an application inside and outside the UK.

The cash funds to be shown by each family member depend on the relevant PBS category and this may cause some confusion. It is important to refer to Appendix E of the Immigration Rules.

For instance, the partner of a Tier 1  holder applying for an entry clearance will need to show that he/she has held a daily minimum balance of £2800 for the three months preceding the application, while the spouse of a  living in London will need to have £533 for each month for which the entry clearance is granted with a maximum amount up to of £4797 (9 months). If the partner is already dependant on a student who is applying for an extension he/she will need to show £533 for two months. However, if the Tier 4 (Migrant) is studying outside London and extending his/her leave, his/her partner will need to show a minimum monthly amount of £400 for two months.

The only family members exempt from the maintenance requirement are those of a Tier 1 Investor. Special procedures apply to family members of a Tier 2  holder.

Considering the complexity and confusion surrounding the maintenance criteria, we would strongly advice a potential applicant to seek expert legal advice.
