Tier 1 - Highly Skilled Workers

The Points Based System has been implemented through successive Statements of Changes in the Immigration Rules.

The Tier 1 category is the only tier of the UK’s managed migration structure that does not require applicants to have a Certificate of Sponsorship as it aims to attract the most talented migrants.

Under the Tier 1 scheme, applicants may apply through one of the following categories:

HSMP/General

The General category is the ideal choice for highly skilled candidates who wish to enter the UK in order to undertake employment or self-employment.

Post-study work

The Post - Study Worker (PSW) category provides a short-term bridge to employment in the UK for the most talented non-EEA national graduates. Candidates who remain in the UK under the post study route are advised to switch their status to another category as soon as they qualify since the PSW does not lead to settlement.

Entrepreneurs

Applicants in this category are assessed on the basis of their ability to invest in the UK economy by setting up or assuming control of a business. Candidates must also be involved in the day-to-day running of the enterprise concerned.

Investors

The Investor stream of the Tier 1 scheme is for individuals making a substantial investment in the UK. An investor will be allowed to work or be self-employed and does not need to meet the English language requirement.

Requirements

In the sub-categories of the Tier 1 scheme, candidates will be assessed against specific requirements. However, common to most categories are the general requirements to be fluent in English and be able to maintain yourself financially.

Dependants

A successful applicant is entitled to bring their dependants with them, including their spouse, civil partner, unmarried partner, and/or children.
