Who can apply under section 6 (2) of the British Nationality Act?
Jan 28
There is still some confusion which regards to who is eligible to apply as the dependant of a British Citizen or someone settled in the UK under section 6(2) of the 1981 British Nationality Act. Only spouses and civil partners are entitled to apply under this section, whist unmarried partners need to satisfy the five years residence requirement having held ILR for 12 months. This is likely to change once the 2009 British Act comes into effect in July 2011.
