Dependant relatives of Tier 1 and Tier 2 applicants
If you are currently in the UK under the Points Based System (PBS), you be able to sponsor your immediate family, however, not other family members such as elderly parents or siblings.
Under paragraph 317, the Immigration Rules allow a dependant relative of a settled person, namely someone with Indefinite Leave to Remain (ILR) in the UK, to apply for a visa if they satisfy the financial dependency criteria and have no other close relatives who are able or willing to support them in their country of nationality. However, this category does not apply to PBS dependants so it would be a wholly exceptional application and the applicants would need to demonstrate serious and compelling circumstances.
