Tier 1 - Highly Skilled Workers
The UK visa application process can be a minefield for anyone not completely up to date with the current immigration legislation. At Migra & Co, it’s our business to know and be fully aware of constantly changing legal requirements in order to secure the approval of our clients' visa.
The Tier 1 category is the only tier of the UK’s managed migration structure that does not require applicants to have a UK based sponsor as it aims to attract the most talented migrants. Under the Tier 1 scheme, applicants may apply through one of the following categories:
Applicants in Tier 1 Entrepreneur category are assessed on the basis of their ability to invest in the UK economy by setting up or assuming control of a business. Candidates must also be involved in the day-to-day running of the enterprise concerned.
The Investor stream of the Tier 1 scheme is for individuals making a substantial investment of at least £1,000,000 in the UK. An investor will be allowed to work or be self-employed in the UK and does not need to meet the English language requirement.
The Tier 1 General visa category is now closed for migrants from outside of the UK. However, those currently under the highly skilled category can extend their Tier 1 General visa as long as they can show they meet the criteria.
The Post - Study Worker (PSW) category provides a short-term bridge to employment in the UK for the most talented non-EEA national graduates. Candidates who remain in the UK under the post study route are advised to switch their status to another category as soon as they qualify since the PSW does not lead to settlement.
In the sub-categories of the Tier 1 scheme, candidates will be assessed against specific requirements. However, common to most categories are the general requirements to be fluent in English and be able to maintain yourself financially. A successful applicant is entitled to bring their dependants with them, including their spouse, civil partner, unmarried partner, and/or children.
