EUSS deadlines and how to withdraw an application?

EEA citizens and their family members who have been residing in the UK prior to 31.12.2020 are allowed to apply for either EUSS Pre-settled status or Settled status depending on how much time they have already spent in the UK at least until 30 June 2021. It is very unlikely that this deadline will be postponed. There are certain circumstances that will be considered by the Home Office if an applicant were to submit an application after the 30 June deadline and discretion might be applied in their favour.

However, there is no deadline for family members of “relevant” EEA citizens, such as a spouse, civil partner, durable partner, child/ grandchild/dependant parent/grandparent if applying for a Family Permit from outside the UK.

For those who are a joining family member of a relevant EEA citizen, if they arrived in the UK on/after 1 April 2021, they will need to apply for leave to remain under Appendix EU within 3 months of the date of their arrival to the UK. Please note that if a specified spouse or civil partner of a Swiss citizen who arrived in the UK on/after 1 April 2021, the deadline is within 3 months of the date on which they arrived in the UK and before 1 January 2026.

Children who were born in the UK on/after 1 April 2021, the deadline of the application will be within 3 months of the date on which the child was born or adopted in the UK.

How can you withdraw an application under EUSS?

Individuals can withdraw their applications in the UK or outside the UK by written request online or by post.

Withdrawing the application online

Migrants must request to withdraw an application by using the following website: https://eu-settled-status-enquiries.service.gov.uk/start, and select the option for asking a question about ‘An application submitted and in progress’.

Withdrawing the application by post

If an individual wishes to withdraw their application by post, they must send a withdrawal request to:

Please note that the Secretary of State does not have to agree to withdraw an application and may still consider and decide the application even where the latter might lead to a refusal. For instance, if there doubts as to whether deception has been used by the migrant or fraudulent documents were used to support their applications.
