18 Jun Update on the status of EEA nationals post Brexit

Further details have emerged in the report by the Home Affairs committee regarding the future of EEA nationals in the UK post Brexit.

In particular, registration will be required from EU nationals arriving in the UK during the transitional period 29 March 2019 and 31 December 2020 provided that they intend to stay longer than 3 months. Details regarding the registration scheme have not yet been clarified.

As announced the EU Exit Settlement Scheme will be launched by the end of the year and EU nationals and their family members will be able to apply under this scheme until 30 June 2021. However, provided that family relations exist from before 31 December 2020, EU nationals who reside in the UK before this date will be able to apply for their direct family members to join them. As o future partners, the domestic Immigration Rules will need to be satisfy.

In addition, the new application process for EU nationals and their families will be launched buy the end of 2018. The government has reassured on numerous occasions that this will be a user-friendly, digital process. Moreover, applicants under the new scheme will be entitled to “furnish supplementary evidence or remedy any deficiencies where it appears a simple omission has taken place”.

With respect to the citizenship applications, the UKVI has suggested the introduction of a new priority service as well as a more streamlined customer experience. In light of the Windrush, the government is carefully considering the lessons learned and aims to improve the system by looking at past mistakes and correcting them.
