{"id":2721,"date":"2019-04-09T11:31:01","date_gmt":"2019-04-09T10:31:01","guid":{"rendered":"https:\/\/www.migraco.com\/en\/?p=2721"},"modified":"2019-04-09T14:43:53","modified_gmt":"2019-04-09T13:43:53","slug":"who-can-be-qualified-as-a-family-member-of-an-eea-national","status":"publish","type":"post","link":"https:\/\/www.migraco.com\/en\/who-can-be-qualified-as-a-family-member-of-an-eea-national\/","title":{"rendered":"Who can qualify as a family member of an EEA national?"},"content":{"rendered":"<p>Under regulation 7(1) (a), (b) and (c) of the EU Regulations 2016, a <strong>direct<\/strong> family member of an EEA citizen can be considered as:<\/p>\n<ul>\n<li>Spouse or civil partner;<\/li>\n<li>Direct descendants of the EEA national or their spouse or civil partner who are:<\/li>\n<\/ul>\n<p>1) under the age of 21 2) dependants of the EEA national or their spouse or civil partner<\/p>\n<ul>\n<li>Dependent direct relatives in the ascending line of the EEA national or their spouse or civil partner.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Extended family members of EEA nationals<\/strong><\/p>\n<p>Regulation 8 defines an extended family member as a person who is not a family member of an EEA national under regulation 7(1) (a), (b) or (c) and who is either:<\/p>\n<ul>\n<li>A relative of an EEA national who is residing in a country other than the UK and is dependent on the EEA national;<\/li>\n<li>Is a member of their household and either:<\/li>\n<\/ul>\n<p>1) is accompanying the EEA national to the UK or wishes to join them<\/p>\n<p>2) has joined them in the UK and continues to be dependent on them or to be a \u00a0member of their household<\/p>\n<ul>\n<li>A relative of an EEA national who strictly requires the personal care of the EEA national due to serious health grounds;<\/li>\n<li>A relative of an EEA national who would meet the requirements of the Immigration Rules for indefinite leave to remain (other than those relating to entry clearance) as a dependent relative of an EEA national as if the EEA national was a person present and settled in the UK;<\/li>\n<li>The partner (other than a civil partner) of an EEA national who can prove they are in a durable relationship with the EEA national.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Please note that the term <strong>\u2018relative\u2019<\/strong> includes brothers, sisters, aunts, uncles, cousins, nieces, nephews etc.<\/p>\n<p><strong>Contact Our Immigration Team<\/strong><\/p>\n<p>For expert advice regarding any aspect of the EEA family permit and the EU Settlement Scheme family permit, please contact our immigration team on 0203 384 3075 or contact us <a href=\"https:\/\/www.migraco.com\/en\/contact\/\">here<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Under regulation 7(1) (a), (b) and (c) of the EU Regulations 2016, a direct family member of an EEA citizen can be considered as: Spouse or civil partner; Direct descendants of the EEA national or their spouse or civil partner who are: 1) under the&#8230;<\/p>\n","protected":false},"author":2,"featured_media":2722,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[19],"tags":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v22.8 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Who can qualify as a family member of an EEA national?
