As an EU, EEA or Swiss citizen, you and your family are able to apply for \u2018settled\u2019 or \u2018pre-settled\u2019 status under the EU Settlement Scheme or for permanent residence card under the EEA Regulations 2016. In addition, the EU nationals\u2019 family members, can also apply for a 5 years residence card under the EEA Regulations 2016.<\/p>\n

Applying for \u2018Settled\u2019 and \u2018Pre-settled\u2019 status under the EU Settlement Scheme<\/strong><\/p>\n If you have lived in the UK for a continuous 5 years period by 31 December 2020 (or by the date that the UK leaves the EU without a deal), you are able to apply for the \u2018settled\u2019 status under the EU Settlement Scheme.<\/p>\n However, if you have not resided in the UK for a continuous 5 years, you can apply for the \u2018pre-settled\u2019 status under the EU Settlement Scheme. Please note that you must have started living in the UK by 31 December 2020 (or by the date the UK leaves the EU without a deal). You will then be able to lodge an application for \u2018settled\u2019 status once you have reached 5 years\u2019 continuous residence in the UK.<\/p>\n Applying for a permanent residence card under the EEA Regulations 2016<\/strong><\/p>\n The EU citizens and their family members are able to apply for a permanent residence card once they have resided in the UK for a continuous 5 years period. However, they also must be a \u2018qualified person\u2019 throughout the 5 years.<\/p>\n What is the \u2018qualified person\u2019?<\/strong><\/p>\n A \u2018qualified person\u2019 is the citizen who is in the UK as a worker, student, self-employed, self-sufficient, or a job-seeker (only if they meet certain conditions).<\/p>\n Please note that if you would like to apply for a \u2018settled\u2019 or \u2018pre-settled\u2019 status under the EU Settlement Scheme, you do not have to exercise treaty rights in the UK.<\/p>\n Family members of the EU nationals<\/strong><\/p>\n If the family members of an EU national would like to join his\/her partner in the UK, there are 2 separate routes:<\/p>\n <\/p>\n Under the EU Settlement Scheme family permit, the applicant must be a \u2018close\u2019 family member of an EU national and who has been issued with \u2018settled\u2019 or \u2018pre-settled\u2019 status.
